フィリピントヨタ労組の闘いに心をよせてくださる皆さんへ フィリピントヨタ労組(TMPCWA)のエド委員長よりフィリピン最高裁がフィリピントヨタ社に組合と労使協議をはじめるようにという裁定をくだしたという嬉しいニュースと皆さんから要請文を送って下さいというお願いがとどきました。争議の経過と 1.要請文のサンプルレター 2.訳文 3.エド委員長からの全文と量がおおくて申し訳ないのですが、転送します。重複して受け取られる方、お許しを。 皆様もご存知のように、フィリピントヨタ社は、フィリピントヨタ労組が一般従業員を代表する労働組合であるというフィリッピン政府の裁定に従わず訴訟を重ねたため、2001年3月末から2週間、TMPCWAは最後の手段であるストライキにおいこまれました。ストライキ後、会社はTMPCWAの執行委員全員をふくむ233人を不当解雇しただけではなく、ストライキ中にスト破りをしようとした会社側人間に暴言をはいたという理由で、組合員23人に刑事訴訟もおこしました。 TMPCWAは、大きく3種類の裁判闘争ー1.組合の承認と労働協約交渉(CBA)を要求して、組合が会社を訴えている裁判 2.違法ストライキをしたとして会社が組合を訴えている裁判 3.刑事訴訟で会社が組合員を訴えている裁判―をかかえています。この1の裁判にかんして最高裁から組合よりの裁決が、先日、下されました。フィリピントヨタ社は組合を交渉相手と認め、CBAを開始しなければなりません。過去一度も交渉のテーブルについたことがないフィリピントヨタ社は、この裁定の対応におおあわてなようです。 エド委員長からのお願いは皆さんから(組織でも個人でもかまいません)、フィリピントヨタ社へ労使協議の開始と組合員の職場復帰・刑事訴訟の取り下げをもとめる要請状をEメールかFaxで送ってくださいということです 。 下記のサンプルレターをお使いになられる時は、日付/氏名・組織名を書きこみ、 フィピントヨタ社(Email:david.go@toyota.com.phかFAX:63-2845-0343/63-2843-2937)に送って下さい。 同時に、TMPCWA(tmpcwa@edsamail.com.ph)に皆さんの要請文を転送するかコピーで送ってくだされば幸いです。 最後にエド委員長からの英文の全文があります。 国内外のお友達に転載してください。よろしくお願いします。 遠野はるひ(フィリピントヨタ労組を支援する会事務局) 1.SAMPLE LETTER: [date ] Mr. Nobuharu Tabata The President Toyota Motor Philippines Corp Dear Mr. President, We learned that the Supreme Court of the Philippines had recently issued a resolution regarding the injunction case issued by the Court of Appeals last July 21, 2001. According to the resolution, the Supreme Court of the Philippines set aside and nullified the resolution of the Court of Appeals, which enjoined the union to demand collective bargaining and negotiation. It was the 16th of March in 2001 that the Secretary of Labor of the Philippines had affirmed with finality that the TMPCWA is the sole and exclusive bargaining agent for the purpose of starting the collective bargaining negotiation. However, despite such finality of the decision, the Toyota management refused to start the negotiation with the union, while successfully securing an order from the Court of Appeals. Besides that, the Toyota management terminated the employment of 233 union officers and members who took a step to go on a strike for justice. We strongly request TMPC to reinstate the illegally dismissed workers and withdraw the criminal cases, while following and respecting the law and the decision of the Supreme Court, and start the negotiation in good faith with the union as soon as possible. Yours sincerely [name / organization] 2.サンプルレター訳文 (日付) フィリピントヨタ社 田畑 延明 社長 フィリピン最高裁は、先日、2001年7月21日に高裁が出した一時差し止めに対する裁定を下しました。このフィリピン最高裁の裁定により、高裁の一時差し止めは無効になり、組合は労使協議を要求することができます。 労働雇用省長官は、2001年3月16日、最終的に、TMPCWAが労使協議をおこなえる唯一の組合であることを確認しました。この最終裁定にもかかわらず、トヨタ社は組合と労使交渉を開始することを拒否し、高裁から一時差し止めの裁定を確保しました。そればかりか、正義をもとめてストライキにたちあがった233名の組合員と組合役員を解雇しました。 私たちはフィリピントヨタ社がこの最高裁の良識ある裁定に従い、TMPCWAと早急に労使協議をはじめることを強く要求します。同時に、組合員の職場復帰と刑事訴訟の取り下げを強く要求します。 敬具 (氏名) (組織名) 3.エドTMPCWA委員長からの全文 Dear friends We have very good news to all of you. The CBA of TMPCWA was stopped by the Court of Appeals on June 29, 2001, because of the P500,000 bond of Toyota management and issued preliminary Injunction on July 21, 2001. The Union filed an appeal to the Supreme Court . The Supreme Court issued a resolution that the injunction of the Court of Appeals was SET ASIDE and NULLIFIED on September 24,2003. Therefore Toyota management must respect this resolution and face the union and start the CBA negotiations. Toyota Motor Philippines Corporation (TMPC) disregarded the decision made by the Secretary of Labor issued a decision of the certification of election on March 16, 2001, that TMPCWA as the Sole and exclusive bargaining agent and they never tried to have negotiations with the Union at all. As a result of this, the workers were forced to depend on the last resort, going on a two-week long strike. TMPC claimed that the strike was against law, dismissing 233 workers without any good reason. In addition, the company went far to take a criminal action against 25 union members because of a "grave coercion" that they stared and railed at some persons standing by the company amidst the strike. They were indicted with the Fiscals Office in March 2002, and were to be put into prison unless they offered bail. On top of that, the company threatened the Philippine government that it would retreat from the Philippines, together with other Japanese companies, unless the labor dispute was resolved to their satisfaction. This helped them get a decision favorable to them from the Philippine government. TMPCWA repeatedly campaigned, however, in front of the Higher Court and Supreme Court, successfully gaining at last the reasonable decision made by the Supreme Court. The Toyota management has no more reason for not facing the Union-TMPCWA, to recognize the union and start to sit for a CBA negotiation. We seek some help to all friends of TMPCWA, to rain letters of support pressuring TMPC to demand that TMPC must respect the Decision of the Supreme Court and to recognize the Union-TMPCWA and start the CBA negotiation. And also to reinstate all illegally dismissed union officers and members and to withdraw all fabricated criminal cases to some 25 union officers and members.
